When Barrack Obama was elected as the leader of the free world, and the President of the United States of America, he talked extensively of change, particularly of health care reform and why it was necessary. As a result, this is an exciting time for health care reform in the United States because, no matter how some people call it too little, or too much, something is happening. As a result, this paper is going to establish an overall, unbiased, account of just what it is that the new health care reform legislation entails, and what it means for the average American.

There are several take on what it means, but few people really have an understanding of what the new law is going to accomplish and how it is going to change the system; that has to change. People generally fear, and hate, what they do not comprehend, as such, the only way to find common ground and reach for the good of all Americans is to eliminate misunderstanding through enlightenment.

The ultimate issue is that people simply do not understand what the law entails for them personally. A few of the items on the bill that people are more aware of include an expansion of the Medicare program as well as an extension of the age limit that allows for children to remain on their parents insurance.

Still, the Act does much more than that. Additionally, the National Health Care Act works to eliminate the private insurance companies, so that all that remains are public and non- profit organization, for the majority of basic care. That is to say that the government is trying to limit how high insurance rates are allowed to rise so that the services everyone needs can remain affordable; at least to a greater extent.

Also going hand- in- hand with is the expansion of places one is allowed to use their insurance. Before the act was proposed, and summarily enacted, insurance companies limited the doctors that one could visit when they were in need of physician care. Now, as the act moves into total application insurance will be applicable to any publicly- funded clinic, hospital, etc…. One of the aspects greatly misunderstood by the majority of Americans involves finances.

So too, included in the Act is a portion that makes it illegal to have an insurance company attempt to charge for any service which the Act mandates as free. That is to say, the government is attempting to limit duplicating coverage at the expense of innocent, uninformed, Americans. Additionally, however, they are allowed, some might even say encouraged, to privately insure medically unnecessary procedures, cosmetic alterations, for example.

Of course, there have to be ways to pay for all of these changes to the system; the obvious answer is going to be taxes. What those affected need to be made aware of, however, is that those taxes are not simply going to be imposed on everyone.

Instead, an additional tax will be placed on top earners in the nation, certain stock transactions, etc… Clearly there is also going to be a re- routing of funds from other health care programs into the new budget for this act, as well as, certain, already existing, health taxes will be applied to the program in lieu of insurance premiums.

There are some other allocations, sections that attempt to help keep unemployed peoples insured, as well as making public records widely accessible across medical facilities but also confidential. Additionally, there are a few other inclusions with the Act which are minor, like the eventual inclusion of the Indian Health Services. It makes sense as the United States of America is the last developed actor within the international system to have some sort of government involvement in public health care.

Still, there are going to be profound ramifications like access, cost, and quality; all of which are area that deserve to be explained and evaluated.

Given increasing financial pressures and the top-priority status that must be given to direct patient care, managers may find it difficult to find time to review or update policies and procedures.

Deferring policy and procedure development, however, may result in negative consequences. Policies and procedures may become outdated, and those who adhere to outdated policies may carry out actions that are no longer consistent with industry-recognized practices. Alternatively, they may simply elect to disregard the policy. Either choice may result in patient harm and a malpractice claim. Evidence that caregivers followed outdated policies may hinder defense of an otherwise defensible claim.

When a domain unknowingly develops a policy or procedure that already exists—perhaps another domain issued a similar policy earlier—there will likely be differences, resulting in confusion as to which policy should be followed. Many healthcare organizations seem to misunderstand the purpose of policy statements and burden them with non-value-added or overly broad information. That may invite a plaintiff lawyer to take a statement out of context and allege that it places an obligation on the defendant that was not intended.

The following example illustrates problematic and preferred phrasing within a policy statement:. The procedure below is intended to promote compliance with the federal Emergency Medical Treatment and Active Labor Act, its amendments, regulations, and reporting requirements. Each policy should include a disclaimer statement to remind staff members that they must use their judgment to determine if all parts of the policy and procedure apply to each situation or whether some type of modification is warranted.

Typical disclaimer statements include the following which should be approved by legal counsel :. When developing or updating clinical policies, the first step is usually to identify whether pertinent professional associations have published practice guidelines on the subject. For example, when writing a policy that pertains to the delivery of patient care in an emergency department, reviewing guidelines issued by the American College of Emergency Physicians and the Emergency Nurses Association would be a logical first step.

Such guidelines are thoroughly researched and vetted by the issuing association before release. These practice guidelines are often introduced as evidence of the standard of care in a malpractice case. Professional association recommendations lack the authority of statutes or regulations, making them advisory rather than mandatory.

If a surgical operation at ABC hospital results in a retained instrument and becomes a claim, the plaintiff counsel will likely allege that the perioperative counts procedure was substandard because it was less rigorous than those recommended by AORN.

The organization has a duty to inform all affected personnel prior to the effective date of a new or revised policy. Failure to do so may cause a staff member to follow an outdated policy, possibly comprising patient care as well as potential allegations of corporate negligence. To protect the organization from corporate negligence claims, documentation that affirms all affected workers—including floating, part-time, and traveling employees—have reviewed the new or revised policy prior to its effective date should be collected and kept on file.

By allowing a period of time between the approval date of a policy and its effective date managers have time for associated training. Legal counsel should determine the length of time documentation of this type of training should be maintained, factoring in applicable statutes of limitations.

When a new policy or procedure pertains to the use of a new medical device, pharmaceutical agent, or clinical procedure, hands-on training may be warranted, in addition to sharing information about the written policies. Define all terms used within the policy. It is useful to put these definitions at the beginning of the policy. Refrain from using superlative words or statements, such as:. Exercise caution when using absolutes such as shall, must, or do not unless intended as such.

Find out on what research the policy was based, what the policy's expected outcomes are, and the plan for implementation. Research the policy and its background. This is one of the most important steps. You should be familiar with the issue the policy deals with. For example, if you are writing an essay on health reform, you should have a good understanding of the current health system, its history, its main strengths and weaknesses, and the principal actors in the industry.

Research the outcomes or potential outcomes of the policy. A policy is a plan for action - how is it to be carried out? If it is a current policy, is it getting the results that were intended? If it is a proposed policy, what factors will affect its implementation? Choose a frame of analysis.

You need to present some criteria on which you are evaluating the policy. Often your professor will tell you what kind of analysis he or she is expecting. Start with an introduction stating the policy and the relevant issues.
